The children of deceased radio legend Casey Kasem have gone to court to gain possession of Casey remains, who they claim currently lie "rotting" in a Norwegian mortuary. The latest in the bizarre battle for Casey's body took a turn toward the best this weekend, when Casey's children asked a judge for permission to bring him home, so he can be buried at a family plot in Los Angeles.

According to daughter Kerri, Casey's body was not properly embalmed when it was shipped from Montreal to Norway, and is decomposing badly, which would hamper efforts for a family requested autopsy to investigate claims of elder abuse against Kasem's wife, Jean.

Kasem died in July at the age of 82 following a long illness. Jean Kasem has since played a game of cat and mouse with Kasem's remains in order to avoid an investigation into allegations she was mistreating Casey in his final days.

"The body is decomposing, and probate code states that if the party with priority fails to bury remains, then the duty to bury can go to the next person on the list. So if a spouse doesn't act, then children or siblings can step in," Gloria Patterson,  attorney for the Kasem children, told The New York Daily News.

Patterson went on to say that an investigation by the LAPD into elder abuse charges against Jean Kasem would be jeopardized by a decomposed body.

Jean Kasem had previously announced Kasem's remains would be buried in Oslo, Norway because of her Norwegian ancestry and intention to take u permanent residence there. Norwegian authorities had previously denied Kasem's family's request to return the body to the States.

Kasem was a beloved disc jockey, who hosted the American Top 40 radio countdown for over 40 years. He also was the voice of Shaggy on the animated series "Scooby Doo Mysteries".

Compounding the case, is a lawsuit filed by Kasem's children over a two million dollar life insurance policy. Both the kids and Jean have laid claim to the policy, and the insurance company wants a judge to determine who gets it, rather than pay out to the wrong party.
