Survivor member Frank M. Sullivan III, who co-wrote the band’s classic 1980 hit, “Eye of the Tiger,” is suing Republican presidential candidate Mike Huckabee over the use of the song.

A lawsuit filed in Chicago accuses Huckabee of playing the tune without permission at a rally for Kentucky clerk Kim Davis, who refuses to issue marriage licenses to same sex couples.

Sullivan, and his company Rude Music, Inc., which holds the copyright to the song, are requesting unspecified damages, and a court order barring Huckabee campaign from using the song again.

Following hte legal filing, neither side would issue a comment on the case, but Sullivan voiced his objections through the Survivor band Facebook page the day after the music was used at the event. By saying 'see ya soon', he implied some legal action would follow.

Sullivan later linked to an article about whther musicians had a right to complain about such matters, and said 'He was done.' Did he mean fed up? Or done with the idea of standing up for his rights.
